Complex Immigration Matters
We also deal with complex immigration problems such as Section 61 Requests, appeals to the Immigration and Protection Tribunal (IPT) and file Ministerial Interventions & Special Directions including complaints to Ombudsman.
Section 61 Requests
If you do not hold a valid visa or your visa has expired or declined and you are in New Zealand you fall under section 61. This means that you are unlawfully living in New Zealand. A request for a visa can be made to Immigration New Zealand by explaining your circumstances for becoming unlawful. This however depends on your individual circumstances and may or may be applicable in all cases. Your situation must be exceptional and only then will a case officer consider it.
At NZ Immigration Visa Limited we advise, prepare and submit requests on behalf of you if we feel that your situation warrants a consideration. Under section 61 an Immigration officer is not obliged to provide a reason for the decisions made. They could either approve or decline the request based on the evidence. We therefore recommend that migrants seek professional advice in such matters.
Appeals to the Immigration and Protection Tribunal (IPT)
We approach the IPT only in situations when Immigration New Zealand declines a visa or when there are merits for an appeal. We can assist with all types of appeals depending upon the situation. We can help structure, submit and advocate on behalf of you as we understand that it’s a challenging and mentally exhausting process.
Ministerial Interventions and Special Directions
A ministerial intervention and/or special direction is normally used in exceptional situations. This is done to achieve the desired outcome by submitting a request to the Minister of Immigration or one of his delegates.
In situations where migrants have become victims to improper advice and have fallen through the cracks of Immigration New Zealand, this option may seem more relevant or appropriate. We can help determine depending on your individual circumstances if this should be the course of action and will prepare and submit a request on your behalf.
